(ANSA) - ROMA, 25 GEN- Mai perdere di vista quel che fanno
le ex mogli: anche quando si trasferiscono in un'altra citta',
e' sempre bene che i mariti separati, specie se le ex pretendono
l'assegno di mantenimento, si tengano ben informati sulle ultime
novita' soprattutto se il divorzio non e' ancora arrivato.
Rimanere all'oscuro di accadimenti importanti nella vita della
un tempo 'dolce meta'' - come la nascita di un figlio da un
altro compagno e la convivenza insieme al nuovo partner - puo'
costare caro. Lo sottolinea la Cassazione (sentenza 1096).
Infatti la Suprema Corte ha bocciato la richiesta di un
medico che non voleva versare 500 euro mensili alla ex moglie
(sposata per 30 mesi e senza figli), 'fuggita' dalla Puglia a
Roma dopo la separazione per vivere insieme ad un altro medico,
benestante, dal quale aveva avuto una figlia proprio nei giorni
in cui il marito presentava la domanda di divorzio. La bambina
era nata una settimana dopo il deposito dell'istanza divorzile e
l'ex marito, all'oscuro di tutto, non aveva potuto allegare il
fatto che la donna avesse una 'nuova famiglia' per non versarle
l'assegno di mantenimento. Questa nuova circostanza ormai non
potra' nemmeno essere oggetto per una revisione delle condizioni
di divorzio in quanto solo gli elementi successivi al divorzio
(come una nuova rendita) potranno essere presi in considerazione
come fatti nuovi. Senza successo, il marito 'mazziato' ha
protestato in Cassazione sostenendo che lui non poteva essere al
corrente dei fatti privati della ex moglie che si era trasferita
in un'altra regione. Convalidando il verdetto emesso dalla Corte
di Appello di Bari che aveva assegnato alla ex un 'vitalizio' di
500 euro mensili, si rileva che ''in sede di revisione possono
prendersi in considerazione solo le circostanze sopravvenute'' e
in tale ambito ''non rientravano ne' la relazione extraconiugale
ne' la nascita di una figlia da tale relazione in quanto
precedenti la pronuncia di divorzio''. Del resto e' ''difficile
ipotizzare'' che il povero ex marito non avesse avuto qualche
'gossip' da amici e parenti. Dunque colpa sua se non ha voluto
saperne di piu'. Per quei 500 euro al mese non c'e' piu' nulla
da fare: nemmeno la nascita di due figli dal suo recente
matrimonio puo' cancellare quell'obolo.
